If you have lost a previous spouse, you must provide proof of their death before you can legally marry again in South Africa. This is a legal requirement regardless of how long ago the death occurred.

The original death certificate of the deceased spouse, issued by the Department of Home Affairs or the equivalent authority in the relevant country. The original or a certified copy is required.

Foreign death certificates
If the death occurred outside South Africa, the death certificate from the relevant country is required. In some cases, this may need to be apostilled or certified before it can be accepted. Raise this with us at your consultation if it applies to your situation.
